Terms of use

This is a translation for convenience; the Portuguese version prevails.

The agreement between you and Hyperpin, written as plainly as possible.

01Who we are

Hyperpin is a product of HYPER IA MARKETING, registered under Brazilian company ID (CNPJ) No. 50.622.314/0001-02 ("Hyperpin", "we"). For anything related to these terms, contact us at contato@hyperiamarketing.com.br.

These Terms of Use apply to the website, the platform at /app, and the websites published through it. By creating an account, you state that you have read and agree to these terms and to the Privacy Policy.

02What Hyperpin does

Hyperpin is a working tool for people who build and sell websites to local businesses. The platform lets you:

  • search for businesses by category and city using public map data and identify the ones without a website;
  • organize those contacts in a CRM and use outreach scripts;
  • generate websites with the help of artificial intelligence, edit them, publish them and export them;
  • calculate pricing, generate contracts from a reference template and record sales.

Hyperpin does not act as an intermediary between you and your clients. You negotiate, sell, charge and provide the service in your own name.

03Registration and account

To use the platform you must be 18 or older and provide truthful information. The account is personal and non-transferable: it may not be shared, resold or used by multiple people.

Each account can be connected on up to 2 sessions at the same time. When you sign in on a third device, the oldest session is closed and you are notified. You are responsible for keeping your password confidential and for everything done through your account.

To prevent abuse of the free plan, we may limit the creation of free accounts per device and block temporary email addresses.

04No guarantee of results

Hyperpin provides tools. We do not guarantee sales, revenue, number of clients, Google ranking or any financial result. Figures shown on the site, such as market price ranges and the revenue simulator, are illustrative and depend on your pricing, your prospecting, your execution and your client retention.

For the same reason, you must not promise your clients results you cannot guarantee, such as "first page of Google" or a guaranteed increase in sales. Such promises can amount to misleading advertising under Article 37 of the Brazilian Consumer Protection Code (Código de Defesa do Consumidor, "CDC").

05Plans, credits, payment and access

The plans, prices and limits currently in effect are listed on the Plans page. Payments are processed by Mercado Pago, via Pix or credit card. Card details are entered directly into Mercado Pago's secure component and never pass through our servers or get stored by us.

  • No automatic renewal. Each payment grants access for a set period (30 or 365 days, depending on the plan). Nothing is charged again without a new purchase made by you, and there is no subscription to cancel.
  • If you pay before your access expires, the new days are added to whatever time you still have left.
  • On paid plans, search credits, AI-generated websites and AI edits renew every 30 days and do not carry over from one cycle to the next. On the Free plan, they are granted once, with no monthly renewal.
  • You can also buy extra credits in ready-made packs (100, 500, 1.500 credits) or in a custom amount, from 100 to 20.000 credits, in multiples of 10. The price per credit for the custom amount is the price of the largest pack it reaches. Purchased credits do not expire and are only used after the cycle's credits are used up.
  • Each search uses 1 credit per new business found. Businesses already in your CRM are not charged, and repeating the same search (same category and city) within 24 hours shows the saved result at no cost.
  • Each plan has monthly limits for AI-generated websites, AI edits and search credits, shown on the plans page. There is also a daily limit on AI calls to prevent automated or abusive use. Extra credits can be purchased at any time and do not expire.

When paid access expires, the account reverts to the Free plan limits. Websites published above that limit are temporarily taken offline, showing a neutral notice, but remain editable and exportable. Once renewed, they go back online immediately. We notify you by email 7 days and 1 day before expiration.

06Right of withdrawal and refund

For purchases made online, you may withdraw within 7 days of payment, under Article 49 of the Brazilian Consumer Protection Code (CDC). Simply request it at contato@hyperiamarketing.com.br; no justification is needed.

The refund is full and made through the same payment method, via Mercado Pago. Once processed, the corresponding paid access is ended and, in the case of a credit pack, any remaining credits from that pack are removed from your balance. Card refunds follow the timelines set by the card issuer.

07Acceptable use

By using Hyperpin, you agree not to:

  • send bulk messages, spam or automated outreach. The platform only opens individual WhatsApp conversations (wa.me), and outreach must respect anyone who has asked not to be contacted;
  • post fake testimonials, reviews, numbers or seals, or any information that could mislead consumers, which amounts to misleading advertising under Article 37 of the CDC;
  • publish a business's website without authorization from the person responsible for it, or impersonate another person or company;
  • disregard rules from professional bodies that apply to your client, such as advertising rules for the legal and healthcare professions;
  • post illegal or discriminatory content, content that infringes third-party rights (including copyright and image rights), or that offers prohibited products and services;
  • attempt to bypass limits, credits or payments, scrape data from the platform automatically, reverse-engineer it, or compromise the security of the service.

Non-compliance may lead to content removal, suspension or termination of the account, without prejudice to any other applicable measures.

08Content and ownership

The content of the websites belongs to you and your clients. Text, photos, trademarks and information you enter, and the content generated for your projects, can be used freely by you and your clients. You only grant us the license needed to host, display and process that content while we provide the service.

The platform, the Hyperpin brand, the code and the website templates belong to HYPER IA MARKETING. A website exported as a ZIP file can be hosted anywhere, for the client it was built for, at no extra charge. Reselling or distributing the templates themselves as your own product is not allowed.

09AI-generated content

Website copy, rewritten sections, outreach scripts and the organization of your prompt are produced by a third-party artificial intelligence model (see Privacy Policy). The AI can make mistakes: it may invent or mix up information, use terms unsuitable for the client's profession, or repeat common industry ideas.

  • Review everything before publishing or selling. Check name, address, phone number, hours, services, prices and professional licenses with the client.
  • When real data is missing, the AI fills in reviews, numbers and testimonials with examples. These sections are flagged in the project as sample data and must be replaced with real data, or removed, before publishing.
  • We apply automatic filters to remove prohibited promises and claims for regulated industries, but they do not replace your own review.

You are responsible for the content you publish on the websites you create and for what you deliver to your clients, including before consumers and professional regulatory bodies.

10Google Maps business data

Search uses the Google Maps Platform to display information that businesses themselves publish on Google Maps, such as name, address, business phone number, hours, rating, number of reviews and photos. This information helps you find and approach potential clients, and it may be incomplete or outdated.

  • When contacting a business, you act in your own name and must comply with the Brazilian General Data Protection Law (Lei Geral de Proteção de Dados, "LGPD"): individual contact, for a legitimate purpose, identifying yourself, and stopping when the person asks you to.
  • Bulk or automated messaging is not allowed, nor is building lists for sale or for third-party registration, nor using the data for purposes other than prospecting for your service.
  • The business owner's approval is required before publishing. The website preview may use the public information from the Google profile only for the client to evaluate. Before final publication, you must obtain approval from the person responsible for the business and record it on the platform. If they do not approve, use "Client did not approve": the Google data and photos for that business are removed.
  • Copying or extracting data from Google Maps outside of the platform's searches (scraping) is also not allowed, nor is bulk exporting it or removing the "Google Maps" attribution shown alongside that data.

Use of this data is also subject to the Google Maps Additional Terms of Service and the Google Privacy Policy, which you agree to by using the search feature.

11Images: stock photos, client photos and Google Maps photos

  • Stock photos (Unsplash). When the client has no photos, we fill out the website with images from Unsplash, under the Unsplash License, which allows free use, including commercial use. Photographer credit is automatically included in the website footer and must not be removed. The license does not allow selling the photo unmodified or using it to build a competing image library, and it does not cover trademarks, logos or identifiable people that may appear in it.
  • Photos uploaded by you or your client. By uploading an image, you state that you have the right to use it (photos owned by the business, with authorization from any people shown, or properly licensed).
  • Google Maps photos. These belong to their authors, who may be the business itself or visitors. Only photos taken by the business itself, with authorization from the person responsible, may be published; photos taken by visitors must be replaced with the client's own photos or stock photos before publication.

12Your clients and the data you process

With respect to the data of the businesses you prospect and your clients, you are the data controller, under the LGPD, and Hyperpin acts as the data processor. It is your responsibility to have a lawful basis for contact, to respond to data subject requests, and not to use the data for incompatible purposes.

The platform's contract template is a reference. For specific situations, consult a lawyer. The agreements you make with your clients, including price, term and maintenance, are your responsibility.

13Hosting and connected accounts

Hyperpin generates the website and provides a temporary link (a Hyperpin address) for the client to approve. Final publication takes place on the account you connect on Vercel, Netlify or GitHub, in your own name. Those accounts, and the plans and limits of each platform, including free tiers, follow each provider's own rules and are your responsibility, and each platform's terms of use and privacy policy apply to your relationship with it.

The access token you provide is stored encrypted (AES-256-GCM) and is only used for actions you trigger yourself: validating the connection, publishing or updating a website, and adding, verifying or removing a domain on that account. We recommend creating a token with the least access possible. You can disconnect the account at any time under Integrations, and the token is deleted; we also recommend revoking it in that platform's own dashboard.

Registering and renewing the client's domain is done by the domain owner with a domain registrar (such as Registro.br in Brazil) and is not included. On any plan, the website can also be exported as a ZIP file, and we recommend keeping an exported copy of your important websites.

14Third-party platforms and availability

Hyperpin depends on other companies' services to work: artificial intelligence, maps and places data, payments, email delivery, hosting, database and stock photos. The full list, with each provider's role, is in the Privacy Policy. Use of these resources is also subject to each provider's own rules.

The availability and response time of these resources depend on these providers. Instability, limits or changes in these services may make features slow or unavailable for some time, such as website generation, map search, payment confirmation or email delivery. We do not offer an availability guarantee (SLA), unless contracted in writing.

When a failure happens, the platform handles your balance as follows:

  • Website generation or AI section edit that fails: the usage is automatically returned to your cycle limit.
  • Search that fails at the maps provider: no credit is deducted, because credits are only debited after the search returns results.
  • Payment with delayed confirmation: access is granted as soon as Mercado Pago confirms it. Before paying again, check your email and the order page. If you are charged twice, we refund the extra amount paid.

On the dashboard, an automatic status bar warns you when we detect instability in one of these services. It is informational: it may not reflect every incident and is not a guarantee of uptime.

15Affiliate program

Approved affiliates receive 40% of the amount paid for plans sold through their link, with a 60-day cookie and last-click attribution. The commission is released 7 days after the payment is approved, is cancelled in case of a refund, and can be withdrawn only via Pix (Brazil), once it reaches R$ 50 (Brazilian reais).

Self-referral, buying ads using the Hyperpin brand or variations, spam and promises of earnings are not allowed. Commissions obtained in violation of these rules may be cancelled. Details at Affiliates.

16Limitation of liability

To the extent permitted by law, Hyperpin is not liable for lost profits, lost business opportunities or indirect damages arising from use of the platform, nor for content published by users or agreements between users and their clients. Nothing in these terms removes rights guaranteed to consumers under the Brazilian Consumer Protection Code (CDC).

17Suspension and termination

You may delete your account at any time under My account. Websites go offline immediately and data is deleted within 30 days, except for what we must keep for legal reasons.

We may suspend or terminate accounts that violate these terms. Whenever possible, we will notify you in advance and give you a chance to export your websites.

18Changes to these terms

We may update these terms. Material changes will be communicated by email or within the platform at least 15 days in advance. If you do not agree, you may close your account before the changes take effect. Access periods already paid for are kept under the conditions of the purchase.

19Governing law and jurisdiction

These terms are governed by the laws of Brazil. Any disputes will be settled in the courts of Guarulhos-SP, Brazil, without prejudice to the consumer's right to bring an action in the courts of their own domicile.
